REALISTICUS ART ACADEMY

TERMS & CONDITIONS

1. Fee Policies & Procedures
1.1 Fees are strictly payable in advance of the first class of term, unless prior payment arrangement.
1.2 Failure to pay fees may result in the loss of the enrollment position.
1.3 If by prior arrangement a student has attended a first art class and have not made the term fee payment it will be due within 7 days.
On the 8th day the unpaid accounts will incur late payment fees of $20. If the account has not been cleared on the 14th day it will be passed on to a debt collection company and any extra fees charged by the debt collecting company will be added to the overall overdue amount.
1.4 There will be no classes held during public holidays and they are not counted into the booking period.

2. Refund Policies & Procedures

2.1 Term Bookings at physical locations

2.1.1 New Students in Term Booking Promo: 'See it to Believe it' Satisfaction Guarantee* - so you can 'see' the results for yourself. We believe 100% in our Programme and have successfully taught it to over 3,000 students all over Auckland. So if within 10 days of your first booking date you choose not to continue, we'll provide you with a full refund of the booking fee, after deducting an Admin Fee.* Only available to new first time students attending at physical locations. Request for a refund must be made within 10 days from the first class date of your Term Booking. Administration fee of $50.00 will apply per student booking. Does not apply to Online Live Art Classes. This promo only applies to term bookings.

2.1.2 For all courses there will be no cancellations & no refunds will be given within 7 days of commencement date unless there is a waiting list and a replacement enrollment can be secured. If you cancel a course more than 7 days before Term /Holiday Programme commencement date you will be entitled to a refund. Bookings can only be processed for the current term and fees cannot be transferred to future terms. All cancellations prior that period will incur a $45 admin fee per student booking. Credit Card online processing fee is not refundable as it get paid to the online gateway provider and we do not profit from it.

2.1.3 MAKE UP SESSIONS : Due to the nature of the programme there are No Make-up classes or credits. But if you advise us at least 3-7 days in advance of a term class being missed and if a spot is available in one of the other classes on the same week as the missed class for the same session at the location owned by the same Realisticus Franchisee, we may be able to offer an optional make up session.The request may only be fulfilled one time during the term. Please arrange this by contacting the Head Tutor/Franchise owner of your location. This may not always be possible if all our classes are full, but we do try our best as a goodwill gesture.

2.1.4 SICKNESS or PERSONAL CIRCUMSTANCES :

• If you miss one or more session during the term due to sickness or holidays, you will still need to pay for the sessions as the space has been held for you. So you will not be entitled to a fee reduction or credit for the missed classes.
• In some cases of illness or injury where the full Term Course has been missed, 50% credit can be given for the consecutive classes missed toward the next term fees upon receiving a Doctors Certificate. In this situation, Tutor must be advised as soon as the parent is aware of the situation, the notice date may affect the credit amount.

2.2 Online Live Art Class bookings

2.2.1 Students Booked for Online Live Art Classes will be eligible for a full refund only if you cancel a course more than 7 days before the Term starting, Admin fee of $40 will apply to all refunds. Due to the way our system works once you have been emailed the Term Class Access link to attend online live classes it is valid for the full Term, so we can't have any trials. Credit Card online processing fee is not refundable as it get paid to the online gateway provider and we do not profit from it.

2.2.2 Transfer from Online Live Art Classes into Classes at physical locations for all students during the period of Covid-19 Coronavirus once Realisticus Art Classes re-open at the physical locations near you, students can choose to be transferred into a class time at the physical Venue. There would be a difference between online live art class fee paid and the art class at the physical venue, so you would need to pay the difference to complete the transfer.

2.2.3 Online Access Link: Access links will be emailed during the week before your first live session of the Term booking. Use the same link to access your class weekly. The link will be emailed to all students with paid bookings, in addition as a reminder we will send one txt message with the link on the first day of your Term booking. If the booking is not paid or is only partially paid the link will not be sent, make sure your booking is paid in full to receive it. The access to online live art class sessions is provided only for the duration of the course and limited to students enrolled in a course.

2.2.4 Online optional Make -Up Time: We have created one set time for all optional make up sessions. If you miss your booked time you would need to ask if space is available at the make up session time If space is available you can attend that time instead on the same week. But as a place at the optional make up session time may not always be available due to class size limit we urge you to do your absolute best to attend your Booked class time, there are no credit for missed classes.

2.2.5 Online class Requirements: It is parents responsibility to check internet connection and to complete successfully zoom.us/test prior booking. We are using Zoom video conferencing platform.

2.3 If you would like to request your booking to be transferred to another class time permanently (can only be applied to same type of class and appropriate age class), your request will be considered and if a place is available and if the change is approved by the head tutor, we will complete the changes in your booking. A Transfer of Student Term booking to a different Realisticus Art Academy franchise business will incur $40 Administration/Accounting fee if not requested and confirmed more than 7 days before Term /Holiday Programme commencement date.

2.4 For any requests we will respond to your request promptly. Should you not hear from us within 48 hours - please check your spam. If still no response please do give us a call to confirm, as nothing can guarantee 100% email deliverability. For any cancellations, you must receive a written confirmation from us that we have received your request for the cancellation to proceed.

2.5 Realisticus reserves the right to cancel or reschedule any class as circumstances dictate. In this case you would be provided online replacement class or if online classes are not available then you will be provided available credit to use for future classes.

2.6 If the Venue is not available for a physical class, (due to Covid 19 restrictions or any other issue) the session will be provided in an Online format as an online live class. Time of class may be the same or adjusted as required. The difference between the price of the physical class and online class will be made available as Available Credit to use for future bookings.

3. Art Stationery
3.1. For In-Person Term classes: Although most art materials are supplied in the classroom, students do need to purchase the basic art supplies pack that they will bring to classes. This pack has been selected out of the most affordable good quality art supplies. It will last for more than two years and we encourage students to use it at home and for school projects, so they can practice newly learnt skills. Option A: New Student Pack. 3.3 For Holiday Programmes: All materials will be supplied, however, if students attend our Term classes already, they are welcome to bring their art packs to keep all their artwork together. It is also beneficial to minimize sharing stationery at this time.


4. Class Uniform Policies & Procedures
4.1. Students can wear what they like to class, but Realisticus Art Academy is not responsible for any damage to the student's clothing.
4.2 When working with acrylic paints aprons will be provided to the Students to use in class.

5. Health, Safety, Injury & Medical Conditions Policies & Procedures

• Realisticus Art Academy is not liable for personal injury sustained or any lost, damaged or forgotten personal property, whilst on the premises. Realisticus Art Academy will aim to provide a safe learning environment to reduce the risk of injury. It is known that generally, art classes carry very low risks of injury.
• Realisticus Art Academy provides qualified art tutors, who actively promote safe art practice.
• It is the student's parents/guardians responsibility to notify their teacher in the event of injury/medical condition prior to class.
• It is the student's parents/guardians responsibility to notify their teacher if the student has any special medical conditions that can affect their behavior in class.
• A first aid kit is available to any student through their teacher or office. We do not provide anyone with Panadol or equivalent or administer any other medications.

6. Safety and Security Policies & Procedures

• 6.1 Realisticus Art Academy students are under supervision whilst in the classroom during Art Class session only. While we endeavor to provide a safe environment, teachers cannot be responsible for students outside their allocated class time or outside the classroom.
• Please make sure your child is accompanied to their Art Tutor by a responsible adult and is picked up from the Art Tutor on time. Do not drop off or allow children to wait by the classroom unsupervised as children need someone to supervise them before the Art Tutor arrives and invites kids into the class , please make the arrangements necessary. Tutors may be arriving from or departing to other venues, there may be an emergency and there may be no supervision.

6.2 If the parent is late to collect their child, the late parent will be charged a Late pick-up fee of $1 per minute from Art Class end time for the first time and $2 per minute for consecutive lateness. The tutor reserves the right to invoice for the additional time directly, additional charges may apply depending on the situation to cover for expenses eg. petrol. If the tutor can not get hold of the parent and the tutor has to leave, the tutor will call the Police for instructions.

7. Class Policies
7.1 Students should not have any sweets before class. This rule is there to increase the ability of children to concentrate and to minimize the disruption in class due to the sugar effects on the behavior of children.
7.2 Students must be punctual to classes to ensure they receive all the pre-drawing instructions from the tutor.
7.3. Regular class attendance is vital for students to develop and keep abreast of their syllabus work. Some of the art projects take 2 x sessions to complete, so the attendance is very important to the student's achievement.
7.4 Class sizes: A minimum of 5 students is required to run a class.
7.5 Realisticus Art Academy maintains the right to dismiss any student who acts inappropriately in the classroom: creates a Health & Safety risk for self or others in the classroom, damages property, causes repeat disruptions to any classes, runs out of the class (run away). Any dismissal and resulting booking cancellation will not be eligible for any refunds nor credit for this booking. In cases of class disruption due to inappropriate behavior The Head Tutor may choose to provide one warning and/or request a parent to sit in the classroom for one session to rectify the behavior, prior the dismissal option. If The Head Tutor sees the student's behavior creates a Health & Safety risk for themselves or other students in the classroom (example: child runs away/ runs out of the classroom/ appears to be out of control ) the Head Tutor has no choice but to dismiss the student and cancel the booking, as Health and Safety risks are treated with serious action.

8. Realisticus Art Academy Certificates.
8.1. At Realisticus Art Academy we concentrate on teaching the students a variety of drawing and painting skills. If a Student has been attending for at least two Terms a Parent can request an assessment for an Achievement Certificate (fees apply). Students artworks would be reviewed to work out the achievement level and the topics studied in the current year. This will be recorded on their Certificate. Certificate fee of $40 for individual assessment will apply. Highly recommended for Graduates and when applying to High Schools and Universities, this is an important document to assist students in their future careers.

8.2. Most years at the end of Term 4 all of our current students enjoy the participation in our end of the year Online Art Show & Prize Giving (fees apply). Online Art Show/Fun Competition & Prize Giving participation fee of $29.00 (incl GST) is included in Term4 Fee. This is a very special occasion to display students Artworks and participate in fun art competitions. Students submit one Artwork created at Home for the Art Show and one artwork created in the classroom as support work. Art Show may not be available every year due to unforeseen circumstances, but we do try our best for our students

9. Photography in the Classroom
9.1. Photography of students in class is permitted only to the Realisticus Art Academy Teacher. Some photographs get published on artacademy.co.nz and https://realisticusartacademy.co.nz/ website and Facebook page as an encouragement to the students to be proud of their achievement and to show them how proud Realisticus Art Academy is to have such students. Group photographs also may be used in our email Updates and Marketing.

9.2 All individuals participating in Realisticus Art Academy classes and other activities, by the fact of allowing a child's participation in such activities, you as a parent give the rights to Realisticus Art Academy to make photographs of the child and artwork. Realisticus Art Academy can use the photographs/video material to track child's progress through the year, media updates and other marketing purposes.

10. Intellectual Property.

10.1 All copyrighted materials in all formats, including the online delivery belong to Realisticus Art Academy. Photography in the Classroom is permitted only to the Realisticus Art Academy Teacher. You may not reproduce any part of the Course Materials without the prior written consent of Realisticus Art Academy. Ownership of original materials created for online classes, including lecture recordings, slides, notes, videos, and images belongs to Realisticus Art Academy.

11. Complaints
11.1. Formal complaints should be made in writing to the Head Office of Realisticus Art Academy. The appointed person from the Head Office will contact the correspondent to verbally discuss the issue(s) and will also write a letter of reply making every effort to find a resolution.
